The plaintiffs argued that the State of Texas was discriminatory in that it violated constitutional law through a narrow approach to equal protection. They challenged the state’s dependence on local property taxes to finance schooling, arguing that it specifically did not grant equal protection of the law to all children as required by the Fourteenth Amendment of the Constitution of the United States.
